SUMMARY DESCRIPTION OF CLASSIFICATION: Under direction of the chief of Human Resources and Development, oversees the Department of Investigations and Compliance; serves as Montgomery County Public Schools' (MCPS) representative to Child Protective Services, local law enforcement and the State's Attorney's Office in matters related to employee conduct. The director leads and coordinates confidential, comprehensive investigations of all suspected, inappropriate, unprofessional, and/or criminal behavior, issues related to Title II, Title VII and Title IX, and underperformance of employees; prepares necessary correspondence, and maintains reports of the results of investigations. Oversees the ADA compliance director who leads department in work related to the assessment of job skills and accommodation of employees and applicants with disabilities Maintains consistent, clear communication, data and reporting with OHRD and other district leaders as required to ensure accountability and transparency. Works closely with schools on all matters related to employee discipline and performance. Ensures compliance with Montgomery County Public Schools policies and regulations, including the Employee Code of Conduct.
MINIMUM QUALIFICATION STANDARDS
KNOWLEDGE, SKILLS, AND ABILITIES: Extensive knowledge of the Americans with Disabilities Act (ADA), EEOC regulations; Title VII and Title IX and effective and comprehensive investigation practices; and extensive knowledge of federal and state laws related to employment and, Fair Labor Standards Act, HB486, child abuse and prevention laws. Thorough knowledge of Title IX and its applicability to sex discrimination and sexual harassment in a K-12 environment. Thorough knowledge of the Americans with Disabilities Act (ADA), EEOC regulations, Rehabilitation Act of 1973, knowledge of state and county retirement systems and MCPS policies and regulations. Knowledge of ADA interactive process and is able to determines ADA accommodations. Understands and is able to oversee the formal Title IX grievance process; investigation procedural requirements; is able to design and oversee thorough investigation plans; conduct trauma-informed interviews and guide investigators in best practices; and oversee/participate in the preparation of comprehensive and accurate investigation reports. Must have ability to conduct confidential investigations and provide written reports of findings. Must have thorough knowledge of and proficiency in the application of and compliance with federal, state, local law, as well as MCPS policy/regulations. Knowledge of Board of Education policies and regulations, state and federal laws, rules, and policies and procedures concerning the rights and privileges of employees including, but not limited to employment, tenure, performance evaluation, due process, and teacher certification. Extensive knowledge of the three negotiated agreements. Knowledge of progressive discipline process and performance improvement planning. Knowledge of school operations. Demonstrated conceptual, analytical, organizational, and management skills. Excellent communication and interpersonal skills. Knowledge and application of the six leadership standards that have been established for the Montgomery County Association of Administrators and Principals (MCAAP/MCBOA) Professional Growth System (PGS).
EDUCATION, TRAINING, AND EXPERIENCE: Master's degree from an accredited college or university in legal studies, criminal justice, risk management or a related field required. Possession of a juris doctorate degree from an accredited school of law highly preferred. A minimum of six years of experience in a compliance role, some of which includes leading an effective compliance investigations team for a large organization, preferably in a public school system. Must have proven experience in Title VII and Title IX investigations and navigating the formal grievance process under Title IX. Training or course work on ADA and considerable experience leading ADA work, including investigations and determining accommodations. Some supervisory experience required. Experience in a law enforcement or legal-related role highly preferred. Coursework and experience in human resources or administration preferred. preferred Other combinations of applicable education, training, and experience, which provide the knowledge, abilities, and skills necessary to perform effectively in the position, may be considered.
CERTIFICATE AND LICENSE REQUIREMENTS: Level I Title IX investigator certification or equivalent required or must obtain within 6 months of hire.

EXAMPLES OF DUTIES AND RESPONSIBILITIES:

Develops, implements and maintains a comprehensive, consistent and effective investigative process for the department. Maintains accurate tracking, records, data and reporting of all cases and matters related to personnel conduct, Title VII and Title IX matters. Provides information and reports to chief and other district leaders as required.

Leads and oversees the development, implementation and evaluation of long-term plans to ensure programs, services and activities are provided in accordance with Title II of the ADA. Supervises and supports all work of the department related to ADA, the determination of accommodations, and ADA complaints, investigations and grievances.

Oversees and monitors investigation cases, investigations of serious cases of employee misconduct; interviews and responds to district leaders, principals regarding parent and staff complaints and other sensitive matters related to employee conduct.

Develops and designs comprehensive investigation plans and trains/leads department staff to adhere to required protocol and best practices, as well as trauma-informed practices.

Leads and informs department employees of all current investigations and compliance best practices, ensuring processes are followed, relative to the Title IX formal grievance process, investigation procedure requirements under Title IX.

Prepares confidential, comprehensive, and accurate reports summarizing evidence gathered, providing analysis, and issuing findings of fact, to support potential personnel actions and recommendations on employee discipline and performance. Testifies, as required, at special hearings before the Board of Education (BOE) and other agencies to support disciplinary decisions. Prepares correspondence on adverse action regarding employee performance or behavior.

Implements progressive discipline process and trains administrators and supervisors in this process. Advises principals and supervisors on performance issues and violations in the workplace and of the Employee Code of Conduct.

Facilitates cross functional human resource management review team meetings.

Maintains accurate and detailed records of employee compliance with MCPS policies and regulations, including the Employee Code of Conduct and mandatory trainings for all staff. Addresses and takes actions related to employees' failure to complete districtwide compliance training as needed.

Oversees equal employment opportunity (EEO) compliance, including accommodations under the Americans with Disabilities Act, as well as workplace bullying and sexual harassment compliance.

Works closely with and communicates with Title IX coordinator to ensure accountability and that procedures, reporting and investigations are comprehensive and properly executed.

Supervises criminal background check process for all employees, and compliance with arrest self-reporting requirements.

Collaborates with the Office of General Counsel and outside counsel in employee litigation. Serves on appropriate committees, task forces, and work groups.

Maintains knowledge and application of federal, state and local laws related to the work of the department.

Develops, provides, or arranges relevant professional development for DCI staff members.

Assists school-based administrators and others in employee investigations.

Problem-solves with administrators and supervisors regarding personnel matters.

Oversees investigation process, prepares reports and correspondence on adverse action regarding employee performance.

Implements progressive discipline process and trains administrators and supervisors in this process. May be called on to represent the superintendent of schools at hearings.

Prepares and presents hearing evidence to the superintendent of schools.

Represents the chief of human resources and development at meetings and on committees and work groups as needed.

Acts as a liaison between MCPS and legal representatives, as well as Montgomery County Police, the State's Attorney's Office, and Child Protective Services.

Oversees the random alcohol and drug screening of employees.

Performs related duties consistent with the scope and intent of the position.
