SUMMARY DESCRIPTION OF CLASSIFICATION: Under direction of the director II, Department of Investigations and Compliance (DCI), Office of Human Resources and Development (OHRD), the Americans with Disabilities Act (ADA) compliance director develops, implements and evaluates standards, practices and procedures for the district, relative to the work OHRD); leads and monitors ADA compliance activities to ensures compliance pertaining to MCPS employees, hiring, and general human resources practices and processes. Oversees, tracks and improves ADA grievance processes; leads investigations; and ensures consistent, equitable and timely processing and determinations for accommodations/modifications requests. In collaboration with the Director II, DCI, the director I oversees and supports ADA work conducted by DCI coordinators. May confer with the Department of Facilities Management in ADA accommodations/modification matters. The ADA compliance director supports the director II in oversight and activities of the department, including communications, investigations and other department activities and may serve as a secondary contact or representative to county partners and agencies, such as Child Protective Services, local law enforcement and the State's Attorney's Office in matters related to employee conduct. Under the direction of the director II, DCI, leads department in work related to the assessment of job skills and accommodation of employees and applicants with disabilities. Maintains consistent, clear communication, data and reporting with OHRD and other district leaders as required to ensure accountability and transparency. Ensures compliance with Montgomery County Public Schools policies and regulations; leads professional development and training activities related to ADA.
MINIMUM QUALIFICATION STANDARDS
KNOWLEDGE, SKILLS, AND ABILITIES: Extensive knowledge of ADA, including Title II, Rehabilitation Act of 1973, including Section 508 and federal, state and local laws, regulations and guidelines related to accessibility for individuals with disabilities and their effective application to OHRD standards, practices, processes and activities. Extensive knowledge of ADA interactive process and ability to assess disabilities and appropriate modifications/accommodations as defined by ADA. Ability to plan, implement and monitor ADA compliance activities; ability to conduct and lead effective, comprehensive investigation practices; interpret applicable laws; and facilitate resolutions of employee grievances. Knowledge of federal and state laws related to employment, such as Fair Labor Standards Act, HB486, child abuse and prevention laws, Title VII and Title IX and its applicability to sex discrimination and sexual harassment in a K-12 environment; and Equal Employment Opportunity Commission (EEOC) regulations. Knowledge of MCPS related policies and regulations. Knowledge of the formal Title IX grievance process; investigation procedural requirements; ability to participate in the preparation of comprehensive and accurate investigation reports. Must have ability to conduct confidential investigations and provide written reports of findings. Knowledge of Board of Education policies and regulations, state and federal laws, rules, and policies and procedures concerning the rights and privileges of employees including, but not limited to employment, tenure, performance evaluation, due process, and teacher certification. Extensive knowledge of the three negotiated agreements. Knowledge of progressive discipline process and performance improvement planning. Knowledge of school operations. Demonstrated conceptual, analytical, organizational, and management skills. Excellent communication and interpersonal skills. Knowledge and application of the six leadership standards that have been established for the Montgomery County Association of Administrators and Principals (MCAAP/MCBOA) Professional Growth System (PGS).
EDUCATION, TRAINING, AND EXPERIENCE: Master's degree from an accredited college or university in legal studies, criminal justice or a related field. Juris Doctorate preferred. Training or course work on ADA required and a minimum of five years of experience leading ADA work for a large organization, including investigations and determining accommodations. Some supervisory experience required, including leading a successful investigations and ADA compliance team, preferably in a large organization or school system. Experience in a legal-related role highly preferred. Coursework and experience in human resources or administration preferred. Other combinations of applicable education, training, and experience, which provide the knowledge, abilities, and skills necessary to perform effectively in the position, may be considered.
CERTIFICATE AND LICENSE REQUIREMENTS: Level I Title IX investigator certification or equivalent required or must obtain within 6 months of hire.

SPECIAL REQUIREMENTS: (Frequent overtime or night work required, etc.) Availability to occasionally work weekends and evenings to make presentations, attend meetings, and complete investigations.

EXAMPLES OF DUTIES AND RESPONSIBILITIES:

Under the supervision of the director II, DCI, leads, plans, oversees and monitors ADA activities and application of relevant federal, state and local laws and district policies, as well as the Rehabilitation Act, for the department and OHRD.

Develops, implements and maintains comprehensive, consistent and effective ADA investigative, grievance, accommodations processes for OHRD. Maintains accurate tracking, records, data and reporting of all ADA cases and matters. Provides information and reports to chief and other district leaders as required.

In collaboration with the director II, DCI, leads and oversees the development, implementation and evaluation of long-term plans to ensure programs, services and activities are provided in accordance with Title II of the ADA. Leads and supports all work of the department related to ADA, the determination of accommodations, and ADA investigations. In collaboration with the director II, DCI, the director I oversees the work of coordinators.

Under the supervision of the director II, DCI, the director I, ADA Compliance, leads department in work related to the assessment of job skills and accommodation of employees and applicants with disabilities.

Develops and designs comprehensive ADA investigation plans, accommodations/modification requests, and grievances; trains/leads department staff to adhere to required protocol and best practices.

Prepares confidential, comprehensive, and accurate reports summarizing grievances, investigations, accommodations, ADA compliance and related activities, and provides data, analysis, and investigation results/findings, to support actions and recommendations.

Supports the work of the DCI director II in the management and supervision of the department and, including but not limited to investigations (including ADA investigations), communications and all other activities as needed; participates and supports the DCI director in cross functional human resource management review team meetings.

Maintains accurate and detailed records of district¿s ADA compliance, complaints, grievances, investigations, resolutions and related legal matters.

Collaborates with the Office of General Counsel and outside counsel in employee litigation related to ADA. Serves on appropriate committees, task forces, and work groups.

Confers with the Department of Facilities Management regarding ADA concerns, queries or investigations, as the relate to the work of DCI.

Maintains knowledge and application of federal, state and local laws related to ADA compliance and the work of the department.

Maintains a case management system of employee requests for accommodations, complaints and grievances; facilitates resolutions; and provides guidance to OHRD/DCI and district leaders on how to address these requests.

Develops and/or provides ADA professional development for DCI staff members.

Receives, investigates, and responds to disability related inquiries and complaints.

Oversees ADA investigation process, prepares reports and correspondence on results and associated actions as needed.

Stays abreast of legislative changes affecting ADA regulations, analyzes the effects, and makes sound recommendations.

Represents the chief of human resources and development at meetings and on committees and work groups as needed.

Serves as secondary contact and MCPS representative for Montgomery County Police, the State's Attorney's Office, and Child Protective Services.

Performs related duties consistent with the scope and intent of the position.
