SUMMARY DESCRIPTION OF CLASSIFICATION: Under direction of the supervisor of the Resolution and Compliance Unit, assists in continuous monitoring of compliance with state and federal regulations regarding students with disabilities, students with Individualized Education Programs (IEPs), and students with 504 Plans; assists in the development, coordination, and implementation of professional development related to compliance with state and federal regulations regarding students with disabilities; assists with the coordination of due process hearings; resolving parent/guardian complaints regarding students with disabilities through administrative review, mediation, and/or resolution sessions; assists with investigation of complaints filed with the Maryland State Department of Education (MSDE). Provides technical assistance to parents/guardians and schools relating to the Individuals with Disabilities Education Improvement Act of 2004 (IDEA 2004), the Section 504 of the Rehabilitation Act of 1973 (Section 504), and Montgomery County Public Schools (MCPS) regulations and processes.
MINIMUM QUALIFICATION STANDARDS
KNOWLEDGE, SKILLS, AND ABILITIES: Thorough knowledge of the organization of MCPS and MCPS policies and procedures. Knowledge of the Code of Maryland Regulations (COMAR) (13A.05.05); IDEA; the Americans with Disabilities Act; Section 504; other legislation that impacts students with disabilities; and Montgomery County Board of Education (BOE) Policy IOB, Education of Students with Disabilities. Demonstrated ability to work cooperatively with parents/guardians and staff members to resolve disputes. Demonstrated leadership ability and ability to collect and analyze data, work with databases and spreadsheets, prepare data reports, and other correspondence. Ability to exercise independent initiative to perform both new and recurring assignments. Ability to use word processing and presentation software. Experience in developing and presenting professional learning for central office and school-based stakeholders. Excellent oral and written communication and interpersonal skills. This position requires the knowledge and application of the six performance standards that have been established for the MCPS Teacher Professional Growth System.
EDUCATION, TRAINING, AND EXPERIENCE: Master's degree from an accredited college or university in special education or a related field. Demonstrated experience with data monitoring and developing and conducting professional learning. A minimum of five years or more experience in teaching, counseling, developing IEPs and/or Section 504 Plans; MCPS procedures related to Child Find, eligibility, evaluations and re-evaluations under IDEA and Section 504, as well as the development of IEPS, Section 504 plans, and testing accommodations. Demonstrated ability with collaborative communication skills to facilitate mediation. Experience with organizational communications, public relations, and community relations is desirable. Other combinations of applicable education, training, and experience that provide the knowledge, abilities, and skills necessary to perform effectively in the position may be considered.
CERTIFICATE AND LICENSE REQUIREMENTS: Maryland Advanced Professional Certificate in special education or related field preferred.
PHYSICAL DEMANDS: (Special requirements such as lifting heavy objects and frequent climbing.) As required by the duties and responsibilities of the job.
SPECIAL REQUIREMENTS: (Frequent overtime or night work required, etc.) Attendance at evening presentations, BOE, and other school system meetings may be required. Minimum of five years of experience in special education, counselling, and/or provision of professional learning to adult learners required.

EXAMPLES OF DUTIES AND RESPONSIBILITIES:

Monitors/audits systemwide data relating to state performance indicators. Inputs data, prepares reports, analyzes data from databases. Analyzes data reports to determine trends and school system needs. Creates and implements professional learning based on system needs. Responds to requests for technical assistance from parents/guardians and MCPS staff members regarding state and federal regulations for students with disabilities (IEPs and 504 Plans). Coordinates the investigation into MSDE complaints, assists with follow-up activities. Coordinates and facilitates mediation sessions with parents/guardians and staff members relating to special education and 504 Plan disputes. Assists the MCPS attorney in coordinating due process hearings. Investigates parents'/guardians' complaints through the administrative review process. Drafts correspondence relating to the above activities. Attends meetings and serves on committees as designated by the supervisor. Assists the unit in implementing the MCPS Strategic Plan and the Antiracist Audit Plan. Coordinates activities and serves as liaison to Office of Special Education units, other central offices, the community, and MSDE. Performs related work and other duties as required. Supports school leaders and staff in the implementation of curriculum and assessment of student learning, including providing professional learning as needed and real-time feedback on instructional practices. Supports teacher leaders with strategies/professional learning to develop organizational processes and practices within departments/teams to enhance communication, coordination, and collaboration. Supports teacher leaders and school teams to develop positive social/emotional learning environments that increase teacher wellness and promote relational trust to advance quality of collaboration. Supports teacher leaders with advancing their ability to plan, lead, and facilitate meetings. Supports teacher leaders with assessing professional learning needs, developing a professional learning progression in alignment with the MCPS Strategic Plan, MCPS Antiracist Audit Plan, school improvement plans, and create differentiated learning opportunities for staff as needed. Provides input into the development of district programs and professional learning to support student well-being and academic achievement. Utilizes student academic and attendance data, evaluating data from the students in the Five Focus Groups and aligned to the Equity Achievement Framework, to inform district programming, professional learning, and support to local school improvement plans. Supports schools in using Evidence of Learning data to inform local decision-making on first instruction, student well-being, academic interventions, and parent/guardian engagement. Consults and supports school teams on appropriate behavioral management and academic supports and interventions for struggling learners. Uses knowledge of Universal Design for Learning, Specially Designed Instruction, effective differentiation, and equitable practices to support schools. Demonstrates ability to collect and analyze data, work with databases, use standardized audit tools, and analyze data reports. Demonstrates knowledge/ability to analyze scheduling at the elementary, middle, and high school levels to determine opportunities for increased inclusion and advancement of access for all students to rigorous coursework. Provides teacher leaders with coaching strategies to support individual teachers who are struggling with the delivery of content and instruction, quality of classroom environment and management, and delivery and analysis of student assessment data. Works closely with teacher leaders and school staff members to support implementation of high leverage instructional practices. Collaborates within the Office of the Chief Academic Officer, and across central office to support system priorities. Office of Special Education, Specialized Roles and Responsibilities: knowledge of COMAR, IDEA, Section 504, and other legislation that impacts services to students with IEPs and 504 Plans. Thorough knowledge of IEPs, 504 Plans special education learning theory, differentiated instruction, data collection, specially designed instruction, Multitiered Systems of Supports, and evidence-based reading and mathematics Tier II and Tier III instructional supports and interventions. Ability to appropriately adapt instructional programs and materials for students receiving special education or 504 Plan services. Ability to use the Maryland Online IEP Tool. Responds to requests for technical assistance from parents/guardians and MCPS staff regarding state and federal regulations and MCPS policies and procedures for students with disabilities (IEPs and 504 Plans), which also may include attendance at school-based and central office IEP/504 Plan meetings as designated by the supervisor. Coordinates and facilitates special education and Section 504 Plan dispute resolution processes with parents/guardians and staff members, including case management of the mediation sessions, providing assistance to the MCPS attorney in coordinating due process hearings, investigating parents/guardians complaints through the administrative review process, coordinating investigation into MSDE Complaints, drafting correspondence relating to the above activities, and overseeing the implementation of follow-up activities. Inputs data, prepares reports, analyzes data reports, to determine trends, and school system needs, including monitoring/auditing systemwide data using state performance indicators and/or MSDE comprehensive audit documents. In partnership with the Department of Special Education Services, develops, facilitates and evaluates professional learning for a range of stakeholders- based compliance trends. Performs related work and other duties as required.
