Policies for Public Comment

PUBLIC COMMENT SOUGHT ON AMENDMENTS TO BOARD POLICY ACF, SEXUAL HARASSMENT, AND NEW BOARD POLICY ACI, SEXUAL HARASSMENT OF EMPLOYEES.

The Montgomery County Board of Education is proposing amendments to Board Policy ACF, Sexual Harassment, and to new draft Board Policy ACI, Sexual Harassment of Employees.  The Board is seeking public comments on the amended Policy ACF and the new Policy ACI from now until May 17, 2021. 

Highlights of the Board’s proposed amendments include the following topics:

  • The draft Policy ACF, Sexual Harassment, has been retitled “Sexual Misconduct and Sexual Harassment of Students” and amended to focus on sexual misconduct among students and sexual harassment of students.
  • A new Policy ACI, Sexual Harassment of Employees, has been created to address sexual harassment of employees (see highlights below).
  • As of last summer, all K-12 education institutions as well as postsecondary institutions receiving federal education funds were required to comply with new federal Title IX regulations. These federal regulations define sexual harassment and set forth procedures that must be followed for reporting, investigating, and remedying to allegations of sexual harassment.  These are now in the Board’s draft policy.
  • The draft Board policy also defines sexual misconduct among students and how allegations of sexual misconduct among students may be reported, investigated, and remedied. 
  • The new draft Policy ACI, Sexual Harassment of Employees, clarifies the two types of federal law that apply to employees:  Title VII of the Civil Rights Act, amended in 1972 and 1991; and Title IX of the Educational Amendments of 1972, which can apply to employees in some instances.
  • New draft Policy ACI sets forth procedures for reporting, investigating, and remedying allegations of sexual harassment of employees.

Public Comment Sought on Amendments to Board Policy ACA, Nondiscrimination, Equity, and Cultural Proficiency

The Montgomery County Board of Education is proposing amendments to Board Policy ACA, Nondiscrimination, Equity, and Cultural Proficiency, and is seeking public comments on the amendments from now until April 1, 2021.  The draft policy reviewed by the Board on January 28, 2021 is available here

Highlights of the Board’s proposed amendments include the following topics:

  • The Montgomery County Board of Education has articulated a long-standing commitment to nondiscrimination, equity, and cultural proficiency, and Policy ACA was substantially revised in 2017 to reflect that commitment.
  • All Maryland public schools are required by the Maryland State Department of Education to update their policies to incorporate terminology and commitments in alignment with regulations set forth in the Code of Maryland Regulations section 13A.01.06.
  • The Policy Management Committee developed draft amendments to Policy ACA, Nondiscrimination, Equity, and Cultural Proficiency, to address language and/or symbols perceived to promote hatred, intimidation, or harassment, in response to the October 27, 2020 memorandum from the Board of Education.
  • Additional draft language has been proposed to reflect the Board’s commitment to antiracism as evidenced by the Board’s action on November 10, 2020 to conduct an antiracism audit of the impact of MCPS systems, practices, and policies on access, opportunities, and equitable outcomes for every student.
