SUMMARY DESCRIPTION OF CLASSIFICATION: Under direction of the associate superintendent of Special Education and Student Services, and in collaboration with the Office of the General Counsel, supervises the Resolution and Compliance unit, coordinates the Dispute Resolution Committee, special education compliance functions and case management supports. Provides oversight of the administrative review process and other proactive central office supported problem-solving strategies related to special education and Section 504 Plan of the Rehabilitation Act issues. Provides professional development and technical support systemwide, as well as to central and school based staff members linked to compliance with federal and state special education laws and Section 504. Serves as the school districts Section 504 coordinator and supervises the implementation of Section 504 processes, including dispute resolution. Provides central office monitoring of special education compliance, State Performance Plan indicators, and special education dispute resolution functions in collaboration with other special education units. Provides systemwide technical support to schools and offices regarding state and federal special education regulations. Coordinates the investigation and response to state complaints and complaints to the United States Office of Civil Rights regarding special education issues, in collaboration with the Office of the General Counsel. Reviews legislation and provides input into recommended changes in MCPS policies and regulations, as well as responses to proposed legislation.
MINIMUM QUALIFICATION STANDARDS
KNOWLEDGE, SKILLS, AND ABILITIES: Thorough knowledge of federal and state special education laws and regulations and of Individualized Education Program (IEP) procedures. Knowledge of the Individuals with Disabilities Education Act and Section 504 of the Rehabilitation Act. Ability to investigate and respond to complaints. Ability to prepare staff members to participate on behalf of MCPS in special education mediations. Excellent organizational, interpersonal, and communication skills. Ability to collect, analyze, and interpret data relative to all functions of the division. Ability to supervise and motivate professional staff members. Provide professional development to school-based administrators and staff members to ensure compliance with relevant legislative mandates. Requires excellent writing skills.
EDUCATION, TRAINING, AND EXPERIENCE: Juris Doctorate from an accredited law school strongly preferred, plus a minimum of two years of progressive experience in one or more of the following areas: public school legal issues pertaining to state and federal special education regulations, student placement in special education programs, special education dispute resolution functions in a large school system or public sector organization. Special education teacher certification and teaching experience would be beneficial.
CERTIFICATE AND LICENSE REQUIREMENTS: Membership in, or eligibility for, the Maryland State Bar preferred. Ability to obtain Observing and Analyzing Teaching I (OAT I) within one year of hire.

EXAMPLES OF DUTIES AND RESPONSIBILITIES:

Coordinates and oversees the work of RACU, including supervision and evaluation of instructional specialists, paralegal, and secretarial staff members

Prepares and coordinates management of cases for MCPS in special education administrative reviews, administrative hearings, mediations, and resolution sessions.

Coordinates administrative reviews, mediations, due process hearings, and complaints filed with the Maryland State Department of Education and the Office for Civil Rights, in collaboration with the Office of the General Counsel.

Assists with the analysis of data and the preparation of special reports.

Conducts professional development on special education and Section 504 procedural compliance and overrepresentation issues.

Monitors State Performance Plan special education data and collaborates with other central office units to develop required action plans, including support for implementation

Updates written documents related to the implementation of the Individuals with Disabilities Education Act and Section 504, as well as professional development resources including webinars

Performs related duties as required.
